Return & Refund Policy

At TomSmitMetalWorks, every sculpture is individually handcrafted with care. We want you to be completely satisfied with your purchase. If you wish to return an item, please read our return policy below.

14-Day Right of Withdrawal

If you are a consumer located within the European Union, you have the right to withdraw from your purchase within 14 days after receiving your order, without providing a reason.

To exercise your right of withdrawal, please contact us within this 14-day period.

After notifying us of your return, you must return the item within 14 days.

Return Conditions

To qualify for a return, the sculpture must be returned in its original condition and must not be damaged beyond what is necessary to inspect the product.

Because our sculptures are carefully packaged to prevent damage during transportation, we strongly recommend using the original packaging when returning your order.

Please package the sculpture securely to prevent damage during return transportation.

Return Shipping Costs

Unless otherwise agreed, the cost of returning the sculpture is the responsibility of the customer.

Due to the size and weight of some of our sculptures, return shipping costs can be significant. We therefore recommend using a tracked and insured shipping service.

Please contact us before returning your sculpture so we can provide the correct return instructions and return address.

Refunds

Once we have received and inspected the returned sculpture, we will process your refund.

When you validly exercise your right of withdrawal, we will refund the payments received from you, including the cost of our standard delivery method where required by applicable law.

If you selected a more expensive delivery method than our standard delivery option, the additional shipping costs are not refundable.

Refunds will normally be made using the same payment method used for the original purchase, unless otherwise agreed.

We may withhold the refund until we have received the returned item or until you provide proof that the item has been returned, whichever occurs first.

Damaged Orders

If your sculpture arrives damaged, please contact us as soon as possible after delivery.

Please include:

Your order number
Clear photographs of the damage
Photographs of the packaging
A short description of the issue

We will assess the situation and work with you to provide an appropriate solution.

Please do not return a damaged item before contacting us.

Handmade & Natural Rust Patina

Every TomSmitMetalWorks sculpture is individually handcrafted.

Small variations in welding, dimensions, steel texture and finish are inherent to handmade products and are not necessarily considered defects.

Many of our sculptures feature a natural rust patina. Variations in colour, texture and rust patterns are part of the intended appearance of the artwork.

The rust patina may continue to develop and change over time, particularly when the sculpture is displayed outdoors.

Natural variations and the continued development of the rust patina are therefore not considered product defects.

Custom & Personalized Sculptures

The statutory right of withdrawal may not apply to sculptures made to the customer's specifications or clearly personalized, where the applicable law provides such an exception.
